NEW YORK, New York — On May 1, 2025, Hof Law LLC formally notified the New York City Council of serious concerns regarding the lack of public restroom access across the city. The firm urged the Council to consider legislative or policy measures that would encourage — or where appropriate, compel — both public and private entities to provide restroom access to at least paying customers, and in all cases where Title VI of the Civil Rights Act of 1964 applies due to the use of Federal funds in the erection and/or operation of the applicable premises.
What may appear to be a minor inconvenience is, in reality, a growing public health and civil rights issue — particularly for individuals with disabilities, medical conditions, and others who may need immediate access to sanitary facilities.
Across the city, individuals are frequently turned away from using restrooms in retail and food establishments, including national chains. This widespread denial disproportionately impacts protected classes and places an undue burden on people who are simply trying to meet a basic human need.
As a firm focused on equity, dignity, and the rule of law, we find it troubling that restroom access is increasingly treated as a privilege rather than a necessity, said Joe Hof, Managing Attorney of Hof Law LLC. This is especially concerning in a city that prides itself on accessibility and inclusion.
Hof Law LLC urges city and state policymakers to consider practical, humane solutions, including:
Requiring large commercial establishments to provide reasonable restroom access to the public;
Implementing a citywide program that encourages businesses to voluntarily participate in a Safe Restroom Access initiative; and,
Reviewing the obligations of businesses that receive public funds or operate in spaces supported by taxpayer dollars.
This is not just a matter of convenience — it is one of dignity, health, and fairness.
